Hovis Live Good Local Challenge - Official Rules

Please read these terms and conditions carefully. You will be legally bound by these terms and conditions (the Official Rules) from the time you submit an application for the Hovis Live Good Local Challenge (the Promotion). If you are a club or group nominated on an application, then you will be legally bound by these Official Rules from the date on which we notify you that you have been nominated and you opt to continue in the Promotion.

Applications

  1. The Promotion will open for applications at 00.01 on 23 April 2018 and close for applications at 23:59 on 25 May 2018 (British Summer Time) (the Application Period).
  2. To submit an application for the Promotion, you must be a resident of Northern Ireland aged 18 or over. Employees of Hovis, Marks Agency or any related companies, their families, agents or anyone professionally connected with the Promotion are not eligible to submit an application.
  3. No purchase is required to submit an application or to participate in the Promotion.
  4. Internet access is required to submit an application for the Promotion.
  5. To submit an application, you need to visit the website at www.hovislivegood.com, download and complete the Hovis Live Good Local Challenge application form and send via email to localchallenge@hovislivegood.com, or print it off and post it to Hovis Live Good Local Challenge, Hovis Bakeries Ireland, Apollo Road, Belfast, BT12 6LP, to arrive no later than 25 May 2018 (the Closing Date).
  6. On your application, you will need to nominate a club or group which meets the following eligibility criteria:
    • based in Northern Ireland;
    • run on a not for profit basis.
    Applications are welcome on behalf of all sections of the community and all age groups. To submit an application, you must be a member of the club or group being nominated. Eligible clubs or groups nominated on an application form are referred to in these Official Rules as a Nominated Group.
  7. 7 You will need to include the following information on the application form:
    • the date of your application;
    • your name;
    • confirmation you are aged 18 or over;
    • your role within the Nominated Group;
    • the name, address and contact details (website, email and telephone) of the Nominated Group;
    • whether the Nominated Group is a registered charity (and, if so, its registered charity number);
    • how long the Nominated Group has been established for;
    • a description of the project the Nominated Group is seeking funding for demonstrating the need for such a project and including key objectives (maximum 600 words);
    • a description of how this will help to improve the Nominated Group while also helping the local community to 'Live Good' (maximum 600 words);
    • a budget breakdown for £3,000 funding if it were to be received as a prize;
    • (optionally) how you heard about the Promotion.
    You will also be asked to confirm that you are authorised to apply on behalf of the Nominated Group and that the Nominated Group agrees to keep the Promoter informed of the roll-out of the project supported by any funding/prizes received through the Promotion and to make that information publicly available;. If you do not provide these confirmations, then the Promoter will not be able to include your Nominated Group in the promotion on the basis of your application.
  8. The Promoter reserves the right to verify the eligibility of anyone submitting an application and the eligibility of Nominated Groups included in applications. The Promoter may require such information as it considers reasonably necessary for this purpose and may withhold any prize or the opportunity to continue into later stages of the Promotion until the Promoter is satisfied with the verification.
  9. Contact details provided and/or available on a Nominated Group's public website or social media page(s) and other information you submit or we review in connection with your application will be used in accordance with our Privacy Notice
  10. If you are a member of the Nominated Group or one or more members of that Nominated Group is known to you personally, then you must ensure that you have confirmation from each relevant member of the Nominated Group (including any individual member that you mention in your application):
    • (a) of their consent to submit the application;
    • of their agreement to these Official Rules;
    • that they are aware of and understand our Privacy Notice
    before submitting the application. The Promoter reserves the right to verify this at any time in the process and to exclude Nominated Groups where it cannot obtain satisfactory evidence that all relevant members of the Nominated Group have provided the confirmation in this section 10.
  11. Please note that if we are not able to contact any Nominated Group (because we do not have contact information or the contact information is not correct), then we reserve the right to exclude them from the Promotion.
  12. You must obtain a written consent from any individual if your application includes information about that individual's:
    • physical or mental health or condition;
    • sexual life;
    • racial or ethnic origin;
    • political opinions;
    • religious or similar beliefs; or
    • trade union membership,
    (known as Special Categories of Data). The consent must state that the individual consents to the processing of Special Categories of Data by the Promoter for the purposes of administering the Promotion, publishing Finalists and Winners and publishing publicity material related to the Promotion.
  13. You must not include anything in your application about the commission or alleged commission of any offence by an individual or any proceedings for any offence committed or alleged to have been committed by any individual (or the findings or sentence of any court).
  14. Screening of applications

  15. The Promoter reserves the right to disqualify any applications if they are:
    • entries submitted using automated means - e.g. a computer program, script or device, or any other method or technique designed to unfairly increase the chances of a Nominated Group proceeding to a later stage of the Promotion or winning a prize;
    • applications submitted in bulk by any third party;
    • applications made in breach of these Official Rules;
    • applications nominating clubs, groups or other entities which are ineligible under these Official Rules;
    • applications where you have not obtained the consent of any individual where the application includes Special Categories of Data;
    • applications which include information regarding the commission or alleged commission of any offence; or any proceedings for any offence committed or alleged to have been committed by any individual (or the findings or sentence of any court);
    • applications where the individual contact at a Nominated Group features on a marketing suppression list of the Promoter;
    • applications where the Nominated Group does not, if and when contacted by the Promoter, agree to participate in the process on the basis of these Official Rules, and any applicable requirements of the Promoter;
    • applications on behalf of a Nominated Group, where all members of the Nominated Group do not agree to participate in the process on the basis of these Official Rules, and any applicable requirements of the Promoter;
    • applications which include inappropriate, discriminatory, illegal or offensive content;
    • applications that seem to be duplicates or not legitimate;
    • dishonest applications; and
    • applications which, in the reasonable opinion of the Promoter, do not constitute a positive endorsement of a Nominated Group.
    You shall ensure, as far as is possible, that you do not make any application referred to in this section 14.
  16. Selection of finalists

  17. Three finalists (Finalists) will be selected from all eligible Nominated Groups on whose behalf an application has been submitted by an eligible applicant (and whose application has not been disqualified at the screening stage in accordance with these Official Rules). Where more than one application is submitted (and not disqualified) for any Nominated Group, only the first application will be considered.
  18. The Finalists will be selected by a panel including at least one independent judge. The Finalists will be the three (3) eligible Nominated Groups, which, in the opinion of the judges, best reflect and encourage the following values (Judging Criteria):
    • Inclusivity - How much the Nominated Group engages with and actively participates in the local community. How the Nominated Group includes everyone regardless of religion, race, sex, orientation or background;
    • Community - How much the Nominated Group is considered to be a positive influence on the local area and environment. How much it encourages everyone to learn, grow and achieve in their lives;
    • 'LIVE GOOD'ness - How much the Nominated Group encourages the local community to 'Live Good', helping them to be more active in body and mind.
    The weightings applied to the Judging Criteria will be as follows: (a) Inclusivity: 20%; (b) Community: 20%; and (c) 'LIVE GOOD'ness: 60%. The Promoter reserves the right to consider information about the Nominated Group gathered from other publicly available sources in assessing the eligibility of any Nominated Group and in the judging process.
  19. Each Finalist will win a prize of £1,000 to be applied for the benefit of the Nominated Group (£1,000 Prize). The Promoter reserves the right to demand repayment of the £1,000 Prize in the event it becomes aware the £1,000 Prize has not been applied for the benefit of the Nominated Group, or has otherwise been used improperly
  20. Finalists will be notified by email and post using the applicant's contact details as provided on the application nominating that Nominated Group (Notification). Finalists must acknowledge this Notification within seven (7) days and must also:
    • confirm their acceptance of these Official Rules in writing; and
    • provide bank details for the Nominated Group, for receipt of the £1,000 Prize and Grand Prize (in case it is won); and
    • provide such other documentation as the Promoter may reasonably request to confirm their eligibility to participate in the Promotion; and
    • if requested by the Promoter, enter into a prize winner's agreement in the form provided by the Promoter;
    by a date to be advised by the Promoter in order to claim their £1,000 Prize and to continue into the final stage of the Promotion. The £1,000 Prize will be paid by bank transfer within 28 days of Notification, subject to the Promoter's receipt of all of the information and documentation specified in this section 18. If the Finalist does not comply with their obligations in this section 18, then the Promoter reserves the right to select a replacement Finalist from the pool of eligible Nominated Groups on the same basis as the original Finalists and to offer the £1,000 Prize and the chance to continue to the final stage of the Promotion to that replacement Finalist.
  21. The Promoter is not responsible for any delay or failure to receive the Notification for any reason, including inactive email account(s), technical difficulties or the Finalist’s failure to adequately monitor any email account. It is each Nominated Group’s responsibility to check spam filters and ensure that any Promoter email addresses are whitelisted in any relevant email account.
  22. Final stage of the Promotion – video entries

  23. The three Finalists will continue into the final stage of the Promotion and will be required to create a short video (Video Entry) of no more than two (2) minutes in length explaining how they would spend the £1,000 Prize and the additional £2,000 prize for the ultimate winner of the Promotion. The videos must be submitted to the Promoter by WeTransfer link to frank.mcgrady@makemarks.com in accordance with the instructions of the Promoter by no later than 20th June 2018.
  24. The Finalists must ensure that their Video Entry:
    • is an original work created solely by the Nominated Group or its members and does not include any content, material or rights owned by any third party;
    • does not include or reference any person other than members of the Nominated Group who have given their consent to featuring in the Video Entry (and, if requested by the Promoter, have signed the form of release provided by the Promoter);
    • does not include any brands or trade marks owned by any person (other than a reference to the Promoter if the Finalist wishes to include one in its sole discretion);
    • does not contain discriminatory, obscene, provocative, defamatory, sexually explicit, or otherwise objectionable or inappropriate content;
    • does not include content which would be contrary to the values included in the Judging Criteria;
    • does not include any content which is or may be in breach of any applicable law regulation or code requirement or which may cause the Promoter to breach any applicable law regulation or code requirement;
    • does not include any content which may serve to adversely impact the reputation of the Promoter, the Hovis brand or trade mark or any Hovis product;
    • does not (and is not likely to) infringe the copyright, trade marks, moral rights, rights of privacy/publicity or intellectual property rights of any person or entity; and
    • does not breach any agreement with any third party.
  25. Finalists must ensure that everyone involved in the creation of the Video Entry consents to the Promoter's use of the Video Entry for the purposes of the Promotion and as set out in section 41 below. If requested by the Promoter the Finalist shall ensure that individuals involved in the creation of the Video Entry sign the form of permission and release provided by the Promoter.
  26. The Promoter reserves the right to disqualify any Video Entry which it deems is inappropriate or in breach of these Official Rules and to not post or remove any such Video Entry from any media controlled by the Promoter and to exclude it from the voting. Alternatively, the Promoter may require the Finalist to provide an alternative Video Entry which complies with these Official Rules or to accept the Video Entry but require that it is edited to comply with these Official Rules. If and to the extent requested by the Promoter, the Finalist shall take down its Video Entry from any social media pages or feeds controlled by the Finalist.
  27. Final stage of the Promotion – public vote

  28. The Promoter shall upload Video Entries complying with these Official Rules to www.hovislivegood.com for public voting. Only votes on www.hovislivegood.com will count for the purposes of the Promotion.
  29. Voting will open at 00.01 on 25th June 2018 and close at 23.59 on 8th July 2018 (British Summer Time) (Voting Period).
  30. One vote per person and per IP address only.
  31. Voters must be a resident of Northern Ireland aged 18 years or over.
  32. To vote in the Promotion, voters will be required to register at www.hovislivegood.com and provide the following information: email address, address and confirmation that they are aged 18 or over.
  33. Voting may only be carried out by individuals on their own behalf. Votes submitted through any third party or any automated or entry duplication method may be discounted. Votes may also be discounted if they are made by voters who attempt to circumvent the limitation on votes by using multiple/different email addresses, identities, addresses, registrations, IP addresses, logins or any other methods.
  34. Finalists must not (and must ensure that the members and supporters of the relevant Nominated Group do not):
    • buy votes, use vote swapping sites or incentivise voters using financial means or any other transfer of value to the voter (including via entries into draws, competitions or other promotions, giveaways or offers or other incentives); or
    • encourage voters to breach these Official Rules (including by submitting more than one vote person or per IP address).
    Finalists involved in any such behaviours or in any other suspicious voting patterns may be disqualified at the sole discretion of the Promoter.
  35. A vote which is not in breach of these Official Rules and which is not the result of a breach of these Official Rules is referred to as a Valid Vote in these Official Rules.
  36. Winner

  37. There will be one (1) winner (Winner) to be announced in the week following the end of the Voting Period. The Winner will be the Finalist whose Video Entry receives the most Valid Votes during the Voting Period. The Promoter shall be entitled to discount from any Finalist's vote count any votes which it reasonably suspects are not Valid Votes in accordance with these Official Rules.
  38. If two or more Finalists are tied for the most Valid Votes at the end of the Voting Period then the Promoter reserves the right to share the prize equally among the tied Finalists.
  39. The Winner will win a prize of £2,000 to be applied for the benefit of the Nominated Group (Grand Prize) and paid by bank transfer within 28 days of notification, subject to compliance with section 35 below. The Grand Prize is additional to the £1,000 Prize won by the Winner, and must be used for the purposes outlined in the video.
  40. The Winner will be notified by telephone/email/post using the contact details for the Nominated Group provided on the application nominating that Nominated Group. The Winner may be required by the Promoter to enter into a further prize winner's agreement in the form provided by the Promoter to confirm::
    • their compliance with these Official Rules; and
    • that the £1000 Prize and the Grand Prize will be used for the purpose described in the Winner's Video Entry (or for such other purposes for the benefit of the Nominated Group as the Promoter may agree).
  41. The £1,000 Prize and the Grand Prize are referred to as the Prizes in these Official Rules.
  42. General

  43. Any decision of the Promoter as to eligibility to submit an application or to take part in the Promotion, or as to the Finalists or Winner of the Promotion, will be final and no correspondence will be entered into. The Promoter accepts no responsibility for applications or Video Entries that are incomplete, delayed, lost, damaged or unreadable/unviewable whether due to failure or non-availability of the website, the submission of incomplete information or any other reason.
  44. The Promoter reserves the right to forfeit any Prize if it reasonably suspects that the relevant Finalist or Winner is not eligible under or has not complied with these Official Rules. In the event that the £1,000 Prize is forfeited, then the Promoter reserves the right to select a replacement Finalist from the pool of eligible Nominated Groups on the same basis as the original Finalists and to offer the £1,000 Prize and the chance to continue to the final stage of the Promotion to that replacement Finalist. In the event that the Grand Prize is forfeited, it shall be awarded to the Finalist receiving the second highest number of Valid Votes during the Voting Period. In the event that the Promoter reasonably suspects that all of Finalists are not eligible under or have not complied with these Official Rules, then it reserves the right (at the option of the Promoter):
    • not to award the Grand Prize;
    • to share the Grand Prize equally between all the Finalists;
    • to award the Grand Prize to the Finalist selected by the judging panel as the Nominated Group which best meets the Judging Criteria; or
    • to disqualify all the Finalists and award the Grand Prize to another Nominated Group, selected by the judging panel as the Nominated Group which best meets the Judging Criteria (following the disqualification of the Finalists).
  45. LIMITATION OF LIABILITY: The Promoter assumes no responsibility or liability for (a) any applications, Video Entries or votes which are not received due to the use of incorrect or inaccurate entry information, any faulty or failed electronic data transmissions, or for any other reason; (b) any unauthorised access to, or theft, destruction or alteration of applications, Video Entries or votes at any point in the operation of this Promotion; (c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers used in any aspect of the operation of the Promotion; (d) inaccessibility or unavailability of any network or wireless service, the Internet and/or the website at www.hovislivegood.com; or (f) any injury or damage to any person, club or group’s computer(s) or mobile device(s) which may be related to or result from any attempt to participate in the Promotion or to download any materials in connection with the Promotion.
  46. By submitting their application for the Promotion, all applicants agree to grant the Promoter permission to use the contents of their application for promotional purposes in any of its social media pages (including without limitation on Facebook, Instagram and Twitter), in digital publications and on its website and across any other media (including media owned or controlled by third parties) without further permission or remuneration.
  47. By submitting their Video Entry, all Nominated Groups and members of the Nominated Group featured in or involved in the submission of the Video Entry agree to grant the Promoter permission to use their Video Entry, together, at the discretion of the Promoter, with any accompanying copy or content and the name of the Nominated Group (and/or its username on relevant social media platforms), for promotional purposes in any of its social media pages (including without limitation on Facebook, Instagram and Twitter), in digital publications and on its website and across any other media (including media owned or controlled by third parties), without further permission or remuneration.
  48. Prizes cannot be transferred and there is no alternative to the Prizes. The Promoter reserves the right (but is not obliged) to substitute a reasonably equivalent alternative Prize to the £1,000 Prize and/or the Grand Prize (as applicable), of equal or greater value, should circumstances make this necessary.
  49. The Promoter reserves the right to delay, postpone or cancel the Promotion in the event of circumstances outside its reasonable control, which it considers make it necessary for it to do so.
  50. Any Finalist or Winner may be required to take part in non-paid publicity or advertising relating to the Promotion, which may include having photos taken at their club or group premises, or of members of the club or group, for promotional and press purposes.
  51. The names of the Finalists will be posted on www.hovislivegood.com for 60 days after the announcement of the FInalists. The name of the Winner will be posted on www.hovislivegood.com after the conclusion of the public vote and the announcement of the Winner by the Promoter for a period of 60 days.
  52. Any personal information supplied in connection with the Promotion will be used, shared and retained as set out in the Privacy Notice of the Promoter posted at www.hovislivegood.com/privacy-notice/
  53. The Promotion and these terms and conditions are subject to the laws of Northern Ireland. Any disputes must be referred to the courts of Northern Ireland.
